Agreement Overview

This Agreement is made between Terrain BhuExpert Innovation Pvt. Ltd.("BhuExpert", "We", "Us") and you as a user ("You", "Your", "User") of the BhuExpert platform.

By creating an account, using our services, or clicking "I Agree" during onboarding, you confirm acceptance of these Terms & Conditions and our Privacy Policy.

1. Platform Purpose

BhuExpert is a technology-driven, fraud-free real estate marketplace that connects builders, sellers, buyers, and associates in a transparent and compliant ecosystem.

Our platform facilitates property listings, verification services, lead generation, and transaction support while maintaining the highest standards of authenticity and compliance.

2. User Categories & Responsibilities

2.1 Builders/Real Estate Companies

  • Must provide accurate company registration details, licenses, and RERA approvals
  • Undergo mandatory eKYC verification for authorized signatories
  • Maintain valid GST registration and all necessary statutory approvals
  • Ensure all project information, pricing, and timelines are accurate and current
  • Honor all commitments made regarding pricing, delivery, and amenities

2.2 Property Sellers

  • Provide genuine ownership documents and property details
  • Complete identity verification through approved eKYC methods
  • Ensure accuracy of property descriptions, images, and pricing
  • Respond promptly to buyer inquiries and maintain professional conduct

2.3 Property Buyers

  • Provide accurate personal and financial information
  • Conduct due diligence before making property commitments
  • Communicate respectfully with sellers and platform users
  • Report any suspicious or fraudulent activities

2.4 Associates

  • Maintain professional standards in client interactions
  • Provide accurate information and transparent commission structures
  • Follow ethical practices in lead generation and customer referrals
  • Complete required training and certification programs

3. Account Registration & Verification

3.1 Registration Requirements

  • Users must be 18 years or older
  • Provide valid email address and phone number
  • Choose appropriate user role (builder, seller, buyer, associate)
  • Complete phone verification via OTP
  • Agree to Terms & Conditions and Privacy Policy

3.2 Verification Process

  • Identity Verification: eKYC through Aadhaar, PAN, or other government-approved documents
  • Business Verification: GST validation, company registration verification
  • Document Verification: Property documents, licenses, and approvals
  • Background Checks: RERA compliance, legal clearances

4. Data Accuracy & Authenticity

You confirm that all information, documents, and data provided during registration and platform usage are:

  • True, accurate, and complete to the best of your knowledge
  • Genuine and not misleading or fraudulent
  • Current and will be updated promptly when changes occur
  • Verifiable through official sources and documentation

Consequences of False Information: Providing false, misleading, or incomplete information may result in account suspension, removal from the platform, and potential legal action.

5. Platform Usage Guidelines

5.1 Permitted Uses

  • Listing genuine properties for sale or rent
  • Searching for properties that meet your requirements
  • Communicating with verified users for legitimate transactions
  • Using verification services and compliance tools
  • Accessing market insights and analytics (where available)

5.2 Prohibited Activities

  • Posting fake, duplicate, or misleading property listings
  • Attempting to circumvent verification processes
  • Engaging in fraudulent or deceptive practices
  • Harassing, threatening, or abusing other users
  • Violating applicable laws, regulations, or RERA guidelines
  • Attempting to hack, compromise, or damage the platform
  • Using the platform for spam, solicitation, or unauthorized marketing

6. Content & Property Listings

6.1 Content Responsibility

You are solely responsible for the accuracy, legality, and quality of all content you upload, including property details, images, documents, and descriptions.

6.2 Content Rights

  • You retain ownership of your content but grant BhuExpert a non-exclusive right to display and promote it
  • You warrant that you have the right to upload and share all submitted content
  • BhuExpert may remove content that violates these terms or applicable laws

6.3 Listing Standards

  • All listings must be for genuine, available properties
  • Images must accurately represent the property
  • Pricing must be current and competitive
  • Property descriptions must be factual and comprehensive
  • Legal documents and approvals must be valid and current

7. Fees, Charges & Payments

7.1 Service Fees

  • Listing fees for premium property promotions
  • Commission charges for successful transactions
  • Verification and compliance service charges
  • Lead generation and marketing service fees

7.2 Payment Terms

  • Fees are due as per the agreed payment schedule
  • Non-payment may result in service suspension or account termination
  • All payments are non-refundable unless specified otherwise
  • Fee structures may be updated with advance notice

8. Privacy & Data Protection

Your privacy is important to us. Please review our comprehensive Privacy Policy which explains how we collect, use, and protect your information.

By using our platform, you consent to our data practices as described in the Privacy Policy, including verification processes that may involve sharing information with government authorities and approved third-party services.

9. Platform Role & Limitations

9.1 Facilitator Role

BhuExpert acts as a facilitator and verification platform. We do not:

  • Guarantee the completion of any transaction
  • Act as a party to contracts between users
  • Provide legal, financial, or investment advice
  • Warranty the condition or value of listed properties

9.2 User Responsibility

All transactions, negotiations, and agreements are directly between users. You are responsible for:

  • Conducting due diligence before any transaction
  • Verifying all claims and representations independently
  • Complying with applicable laws and regulations
  • Resolving disputes directly with other parties

10. Liability & Indemnification

10.1 Limitation of Liability

BhuExpert's liability is limited to the maximum extent permitted by law. We are not liable for:

  • Damages arising from user-generated content or transactions
  • Losses due to platform downtime or technical issues
  • Consequences of fraudulent activities by other users
  • Third-party services or content linked from our platform

10.2 User Indemnification

You agree to indemnify and hold harmless BhuExpert against any claims, damages, or losses arising from:

  • Your violation of these terms or applicable laws
  • False or misleading information you provide
  • Your interactions with other users
  • Breach of contract or delayed possession on your part

11. Account Suspension & Termination

BhuExpert reserves the right to suspend or terminate your account immediately for:

  • Misrepresentation, fraud, or deceptive practices
  • Violation of applicable laws or RERA guidelines
  • Non-payment of charges or fees
  • Repeated customer complaints or platform abuse
  • Failure to complete required verification processes
  • Breach of these Terms & Conditions

Upon termination, your access to the platform will be revoked, and certain data may be retained as required by law or for compliance purposes.

12. Updates & Modifications

We may update these Terms & Conditions from time to time to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated through:

  • Email notifications to registered users
  • Platform notifications and announcements
  • Updated "Last Modified" date on this page

Continued use of the platform after changes constitutes acceptance of the updated terms.

13. Dispute Resolution & Jurisdiction

13.1 Governing Law

These Terms & Conditions are governed by and construed under the laws of India.

13.2 Jurisdiction

Any disputes arising from these terms or platform usage shall be subject to the exclusive jurisdiction of courts in Lucknow, Uttar Pradesh.

13.3 Resolution Process

  • Mediation attempts before legal proceedings
